About This Course

Mortgage disclosure and pricing rules are some of the most heavily cited compliance violations in banking, and some of the most misunderstood. This four-part series walks lending, compliance, and operations staff through the full lifecycle of a residential mortgage: from the moment a Loan Estimate is triggered, through the Closing Disclosure and its special-situation exceptions, into the servicing obligations that continue for the life of the loan under RESPA, and finally through the pricing thresholds that determine whether a loan is classified as a Higher-Priced Mortgage Loan (HPML), High-Cost Mortgage Loan (HCML), or Higher-Cost Priced Transaction (HCPT).

Each session builds on the last, giving attendees a practical, start-to-finish understanding of TRID, RESPA, and the loan-classification rules that drive Ability-to-Repay and Qualified Mortgage status. Whether your team needs a first introduction or a refresher ahead of exam season, this series translates dense regulatory language into the "why" behind the rule, so staff can apply it correctly and confidently, not just recite it.

What You Will Learn

  • Identify the three-part coverage test and application trigger that determine when a loan is subject to TRID and differentiate the zero-tolerance, ten-percent, and unlimited fee tolerance categories
  • Distinguish the two mandatory triggers for a revised disclosure from situations requiring only an optional revision or a tolerance cure, and identify the content, formatting, and delivery requirements that apply to the Closing Disclosure under 12 CFR 1026.38
  • Identify which loans are Federally Related Mortgage Loans under RESPA, distinguish permitted referral-related payments and Affiliated Business Arrangements from prohibited kickbacks and unearned fees under RESPA Section 8, and apply RESPA’s escrow account rules
  • Describe the mortgage servicing protections established under RESPA Subpart C and differentiate which obligations apply to small servicers versus large servicers
  • Differentiate Higher-Priced Mortgage Loans, High-Cost Mortgage Loans, and Higher-Priced Covered Transactions by their purpose, collateral and loan-type triggers, and applicable APR-over-APOR coverage thresholds
  • Apply the Ability-to-Repay standard and the Qualified Mortgage categories under 12 CFR 1026.43 to determine a creditor’s underwriting obligations and resulting legal liability exposure
